| Geographical
indications shall be the word indications which
in an explicit or implicit manner designate the
name and place, locality, region or country /territory/,
which identify a good as originating in that territory,
where a given quality, reputation or other characteristic
of the good is essentially attributable to the geographical
origin of that good.

A foreign geographical
indication may only be granted protection in Poland,
if it enjoys protection in the country of origin.
In geographical indications goods do not mean
services. The geographical indications enjoy a
right in registration /only formal examination/
for 25 years period.
The data/documents necessary
for filing a geographical indication;
- name and address of the Applicant
- determination of the geographical
name with the statement of ways of use thereof
on the market,
- specification of goods
- particular characteristics of
the goods, filling the requirements of a geographical
name,
- specification of the entrepreneurs
/names, surnames, addresses, possibly up to
5, or appx. number of the entrepreneurs/, which
are authorised to use or which will be authorised
to use a geographical name
- map of a territory of a geographical
indication use
- regulations of the conditions
for the geographical indication use ,
- certification of a territorial
administration or local Government, confirming
that an Organization being an Applicant is a
representative of the producers' interest /if
the application is filed by such an Organization/.
- Power of Attorney document.
- certification of a protection
in a country of origin /for foreign applicants
only/.
